The proposal was category 1 remediation work and, on Dr Swane's evidence, the risks to future residents would be much higher if the contaminated soils had not been encapsulated. Clause 12(1) of SEPP 55 meant the application could not be refused because the Site Audit Statement, Environmental Management Plan and conditions of approval, if properly implemented, would reduce the risk to an acceptable level and to a level less than if the work were not undertaken.
