Although the debtor's prospects on appeal may not be great, he had an argument to advance, had prosecuted the appeal for the most part within required times, and his failure to seek a stay or extension did not show a lack of bona fides. The availability of a near-term appeal date also supported adjournment. The creditor's petition was therefore adjourned pending determination of the appeal.
