R v Allen [2020] NSWDC 494

R v Allen [2020] NSWDC 494

The offending was a random, unprovoked act of knife violence of above mid-range seriousness involving the use of a weapon against a minor, causing serious injury without lawful excuse. Aggravating features included presence of other children and grave risk of death. Although mental health issues and expressions of remorse moderately reduced moral culpability and supported a finding of special circumstances, the need for deterrence and denunciation remained strong. Provocation was not established. The plea of guilty warranted a 10% utilitarian discount, with remorse taken into account. The offender was sentenced to a term of imprisonment accordingly.
