The Magistrate did not err in law in summarily dismissing Patrick Costa's claim against Margaret Costa. The issue of contributions to the Fairfield West property, including unequal and extra mortgage payments, was considered in the Family Court proceedings, and if Patrick Costa sought a different adjustment it should have been pursued there or on appeal.
