Section 5 of the Police Offences Act 1890 (Victoria) does not bind the Executive Government of Victoria (or now, the Commonwealth) or its agencies because there is no clear intention in the legislation to bind the Crown. Where the Government lawfully engages agents or contractors to perform governmental duties, such acts are not subject to the licensing or security requirements imposed by local authorities. Accordingly, an individual acting under the authority of a Commonwealth contractor was not guilty of an offence under the Act for carting away nightsoil from Commonwealth premises without a local licence.
