The University of Western Australia v Gray (No 6) [2006] FCA 1825
Because CRI's membership and board could not be determined with reasonable certainty within a reasonable time, and because the persons claiming to be its board were inescapably affected by conflicts of interest, the only reasonable course was to expand the receiver's powers so that an independent receiver could determine and conduct CRI's position in the litigation consistently with CRI's charitable objects, including settling the proceedings with Court approval. The receiver was also entitled to reasonable remuneration, costs and expenses, assessed periodically, and to an indemnity from CRI's assets.
