Because both parties had some success but Mrs Ebner's broad ownership claim was largely rejected and much of the trial was taken up by unmeritorious claims, justice required treating the claim and cross-claim separately but limiting Mrs Ebner to 30 per cent of her costs while awarding the Official Trustee all costs of the cross-claim. Costs thrown away by adjournments were allocated according to the party responsible for the wasted costs. In the absence of direct evidence that the Official Trustee acted unreasonably, the transportation, storage and insurance expenses for the seized chattels were properly recoverable from the sale proceeds.
