Regina v Bradley Lane [2007] NSWDC 337
The court was not satisfied beyond reasonable doubt that Mr Lane initiated the plan or supplied the firearms, but found that he actively participated in planned armed stealing involving loaded weapons. The seriousness of the offences and the need for general and specific deterrence required full-time custody, but the sentence was reduced for the earliest guilty pleas, genuine remorse, lack of prior convictions, first time in custody, emotional vulnerability, excellent conduct in custody and excellent prospects of rehabilitation. Special circumstances justified the non-parole periods fixed, and the sentences were made concurrent because of the close relationship among the offences.
