The plaintiffs failed to demonstrate a serious question to be tried that Mr Gulliver had an equitable interest (by resulting or constructive trust) in Ms Gulliver's property, and accordingly their charge could not attach to such an interest. No evidence showed any financial contribution by Mr Gulliver to the purchase or ongoing maintenance sufficient to satisfy the legal requirements for imposing a resulting or constructive trust.
