R v Duffy [2022] NSWDC 227

R v Duffy [2022] NSWDC 227

The court concluded that the evidence of the complainant, on which the Crown case entirely depended, was so unreliable, inconsistent, and marked by invention and confabulation, and so unpersuasive when tested against other witnesses and objective facts, that no charge was proved beyond reasonable doubt. None of the complaint evidence or tendency evidence filled the resulting evidentiary gap. Accordingly, the Crown failed to discharge its onus and not guilty verdicts were directed on all 23 counts.
