Van Der Poel v Hall and Ors [2009] NSWDC 50
The defendants (David Hall and Jarrod Hall) attended the Finigan property with others in pursuit of a common purpose to assault or intimidate, leading to a violent confrontation. The plaintiffs (Edward and Justin Van Der Poel) were assaulted in the course of the altercation, both as a result of the actions of Mr Barnett (in common purpose) and direct intentional assaults by the defendants. The court found, on the balance of probabilities, both joint and individual liability for the assaults and assessed damages accordingly, including aggravated and exemplary damages for the deliberate and egregious conduct.
