R v Baker [2009] NSWDC 105

R v Baker [2009] NSWDC 105

Although Mr Baker's offence was of utmost seriousness and warranted a lengthy term of imprisonment, his quadriplegia and attendant hardships in custody, including unique physical and social isolation, constitute special circumstances significantly mitigating the sentence. Additional mitigation was appropriate for extra curial punishment suffered due to credible threats to his life and the resulting significant negative impact on his living conditions. The State's increased cost of accommodating a disabled prisoner in custody is not a relevant sentencing consideration.
