R v Stanyard [2012] NSWDC 106
The court held that although the harm caused was catastrophic and among the worst category of grievous bodily harm, the offence itself did not fall in the worst category for sentencing purposes. The offender’s actions showed serious moral culpability, demonstrated by deliberate risk-taking and disregard for warnings, but did not warrant the maximum penalty given the circumstances and absence of intent to cause harm. An overall sentence with both non-parole and head periods as specified, along with a driving disqualification, was appropriate.
