Due to serious failures by the second defendant in timely and adequate particularisation of justification, and admitted prolixity in cross-examination, as well as late amendments, the court exercises discretion under s 48A Defamation Act 1974 (NSW) to award indemnity costs for parts of the trial exceeding original estimates, but not for delays attributable to plaintiff’s legal counsel in 2008. Interest is awarded at an agreed 3% rate, and a partial stay granted on compliance with certain steps.
