Although s. 317B(1) of the Local Government Act 1919-1951 N.S.W. is ambiguous, s. 317B(3) shows that the legislation contemplated orders that may direct demolition. Properly construed, the section gives the council power to order demolition without offering the owner an alternative of re-erection or repair. The demolition order was therefore within power and the decree dismissing the suit was correct.
