ABC Learning Centres Limited, in the matter of ABC Learning Centres Limited; application by Walker (No. 12) [2012] FCA 173

ABC Learning Centres Limited, in the matter of ABC Learning Centres Limited; application by Walker (No. 12) [2012] FCA 173

The Court held that its earlier reasons intended the Exhibit J template to provide a more precise form of order for production but not to expand discovery beyond documents relating to ABC Learning. Discovery extending to the banks' borrowers generally was too broad. The Court also held that access to the banks' manuals and other documents by IMF was not intended, had not been sought on that basis, and would have been contrary to the liquidators' submissions, so no further access order was required.
