R v Gouliaditis [2015] NSWDC 383

R v Gouliaditis [2015] NSWDC 383

Although the offences were serious and had significantly harmed the community, the offender's rehabilitation and other mitigating factors made the court unwilling to conclude at that point that fulltime custody was required. An adjournment under s 11 was appropriate to give the offender a substantial opportunity to prove that his rehabilitation was lasting, that he could remain drug free in the community, and to assist the court in determining any ultimate custodial sentence and non-parole period ratio.
