The Drug Court cannot sentence offenders who have committed federal crimes to a Drug Court program because s 7A(3) of the Drug Court Act 1998 (NSW) clearly requires sentencing in accordance with the Crimes (Sentencing Procedure) Act 1999, and the Drug Court Act's Initial Sentence, suspension, termination and Final Sentence regime cannot be reconciled with sentencing federal offences under the Crimes Act 1914 (Cth).
