Porter v Computer Based Technology Pty Ltd [2004] NSWSC 476
A valid and enforceable equitable mortgage existed in favour of CBT as at 1 February 1996, covering advances made for the benefit of Plantations. The conduct of CBT in lodging the proof of debt was equivocal and did not amount to an irrevocable election to surrender the security. The Plaintiff is not entitled to relief. The First Defendant is entitled to a declaration as to the validity of the mortgage.
