The 1 October 2009 statutory declaration recorded an agreement between the parties that Stannifer be sold and the net proceeds divided 48.84% to the plaintiff and 51.16% to the defendant, but it did not confer on the plaintiff an interest in the land. The plaintiff did not prove that the additional payments were loans rather than gifts or donations toward the home church project. The cross-claim failed because the defendant did not establish the required period of personal care, and in any event the accommodation arrangement at Stannifer was a reward within s 5(2)(a) and no case for adjustment under s 20 was made out.
