Tucker (Administrator) v Bolten (Trustee), in the matter of Quintis Leasing Pty Ltd (Administrators Appointed) (No 3) [2024] FCA 85

Tucker (Administrator) v Bolten (Trustee), in the matter of Quintis Leasing Pty Ltd (Administrators Appointed) (No 3) [2024] FCA 85

Given the recent receipt of a DOCA proposal and the possibility it may provide a better return for creditors than immediate winding up, it was appropriate to grant short further extensions of both the administrators' relief period from personal liability and the convening period for the second meeting of creditors. The limited prejudice to lessors, the opportunity for further proposal development, and the support or neutrality of most stakeholders justified the orders. Ancillary confidentiality and suppression orders were also warranted to protect ongoing negotiations and avoid harm to creditors' interests.
