Semantic Software Asia Pacific Limited v Vince (Trustee), in the matter of Bradley (Bankrupt) [2020] FCA 1007
Although SSAP succeeded in establishing that the funds were held on trust for it, Mr Bradley's suspicious conduct apparently on behalf of SSAP necessitated the proceeding and made it appropriate that SSAP bear its own costs rather than the bankrupt estate or trustee. The trustee acted prudently in scrutinising the claim and seeking cross-examination, but SSAP's conduct did not justify ordering it to pay the trustee's costs. Each party should therefore bear its own costs.
