All statutory conditions for infanticide were met: the offender wilfully caused the death of her seven month old daughter, the act would otherwise have amounted to murder, and the Crown accepted that the balance of her mind was disturbed by reason of not having fully recovered from childbirth. In light of her postnatal depression, intellectual and emotional limitations, genuine remorse and frank admissions, and the low culpability attributable to her circumstances, a custodial sentence was inappropriate and a supervised s 9 good behaviour bond met the requirements of justice.
