If the jury is satisfied beyond reasonable doubt that the Colombians and accused were parties to a single conspiracy to import cocaine into Australia, and that the drugs were placed on Kelso Bank for importation, then only one conspiracy exists within the indictment. If there is reasonable doubt as to this, including that the drugs were not placed for importation but were disposed of or already imported, there may be two conspiracies, in which case certain accused cannot be convicted on the charge. Directions must reflect that only the conspiracy charged, involving the Colombians and all relevant participants, can lead to conviction.
