R v SP (Young Person) [2021] NSWDC 617
Although the young person was 14 at the time of the offence, had no recorded criminal history, had a difficult background reducing moral culpability, showed belated genuine remorse and had reasonable prospects of rehabilitation, the planned and unprovoked knife attack at school, multiple stab wounds, pursuit of the victim and commission in front of other children made the offence sufficiently serious that imprisonment was the only appropriate sentence. A 20% discount was allowed for the guilty plea, and substantial special circumstances justified a non-parole period of 10 months within a total sentence of 22 months.
