The Court held that, in light of the offenders’ substantial impairment of responsibility by abnormality of mind (established through psychiatric evidence), the burdens and devastating effects of their circumstances, their otherwise blameless lives, and the unlikelihood of future offending, a custodial sentence would not serve the interests of justice or the community. Therefore, the appropriate disposition is an order for each to enter into a good behaviour bond, with conditions for treatment and supervision, rather than imprisonment.
