For sentencing purposes, the Court was satisfied beyond reasonable doubt that the offender struck Eden Delir on the head with a bottle as part of a brutal, coordinated and unprovoked group attack, that the act was unlawful and dangerous and caused or substantially contributed to death, and that the offence was extremely grave notwithstanding the offender's youth. The offender's age, lack of prior offending and educational needs justified only a limited adjustment for special circumstances and justified a direction that he serve the non-parole period as a juvenile offender until attaining 21 years of age.
