Hasniyah MURAD v PACIFIC SERVICES PTY LTD & Anor [2004] NSWCA 251
The trolley shunter was a pushing device, not designed to carry or contain any object or person, and did no more than propel the trolleys. Because it was not a vehicle in the natural and ordinary meaning of that word, it was not a motor vehicle within the meaning of the Motor Accidents Compensation Act 1999. The Statement of Claim should not have been struck out on the basis of s108.
