The psychiatric evidence and facts showed that, when he killed Mr Smith, Mr Slater was suffering from grave mental illness, including delusions and acute psychosis of a schizophrenic type, which totally deprived him of the capacity to know that he ought not act as he did. A verdict of not guilty by virtue of mental illness was therefore inevitable. Because the Court was not satisfied that release would not seriously endanger Mr Slater or the public, he was to be detained until fit to be released.
