The statutory definition of 'immigration assistance' in s276 Migration Act 1958 is to be broadly construed. Assistance or advice to a visa applicant (or for sponsorship) can be provided via intermediaries; it need not be provided directly. The naming of an intermediary in a charge is a particular, not an element, and does not invalidate the charge if the substance concerns assistance to a visa applicant or sponsor. Similarly, misrepresentation as a migration agent under s283(1) encompasses both direct and indirect representations, express or implied, and is a single offence.
