CUB did not infringe SAB's trademark or contravene the Trade Practices Act in promotions for Showdown 7 and 9, as use of 'Showdown' was generic and did not constitute trademark use or misleading conduct. For Showdown 10, CUB's promotional material did represent that it was a sponsor of AFC and PAFC and that those clubs had consented to the promotion; these representations were misleading and in breach of ss 52, 53(c) and 53(d) of the Trade Practices Act as CUB was not in fact a sponsor and did not have the clubs’ consent.
