Ms Shen was employed by ASH from May 2014 under oral and then written contracts. She performed substantial work for ASH and was given ongoing, authorised access to its bank accounts, including authority to make payments to herself for entitlements owed. The monies transferred to herself on 21 December 2018 were for outstanding wages, unpaid superannuation, interest on funds loaned to ASH, and agreed guardianship fees, all of which were genuinely owed by ASH. As such, Ms Shen was entitled to retain the sum transferred, and ASH's claim for restitution (money had and received) failed. Even if authority had lapsed, set-off applied for the debt owed to Ms Shen.
