Kogarah Municipal Council v Rockdale Municipal Council [1927] HCA 22

The power of a council to prohibit the disposal of night-soil by burial within its area was not overridden by the statutory power of another municipality to establish such a depot, even where Ministerial approval was given. The approval merely provided a power of veto and did not confer positive authority to act against the wishes of the controlling council. Where the depot constituted a public nuisance, the council was also entitled under section 587 to seek abatement by injunction.
