REGINA v LO [2003] NSWSC 582
The murder was committed during a carefully planned armed robbery, with the offenders armed with lethal weapons and the offender at least foreseeing grievous bodily harm and intentionally assisting Ng by checking whether the victim was still alive before a further throat wound was inflicted. Although the crime was extremely grave, the offender's youth, remorse, reasonable prospects of rehabilitation, harsher strict protection custody, early plea and substantial assistance to authorities justified an overall 40 per cent discount and a finite sentence rather than life imprisonment.
