R v Jennings [2005] NSWSC 789

The Court accepted the evidence of Drs Westmore and Giuffrida that Mr Jennings was suffering from a psychotic illness amounting to a disease of the mind at the time of the stabbing. Although he understood what he was doing, he was so disabled by disease of the mind that, on the balance of probabilities, he did not know that what he was doing was morally wrong. The M'Naghten defence was therefore established.
