R v Heydari [2015] NSWSC 207
The accused inflicted the fatal injury on Mohammed Ali Nabizada and seriously injured Rauf Hassani with intent to kill, but the evidence established on the balance of probabilities that at the time he was suffering from severe depression with psychotic features, a disease of the mind which caused paranoid delusions and deprived him of the capacity to reason with moderate calmness about the moral quality of his actions. The defence of mental illness was therefore made out for both charges.
