R v Opie [2014] NSWSC 814
The Court was satisfied on the balance of probabilities that, when Mr Opie stabbed the deceased, he was suffering from mental illness involving severe mood and psychotic symptoms such that he did not know that it was wrong to act as he did. The agreed psychiatric evidence supported that his underlying mental condition was sufficiently severe to render him unaware of the wrongfulness of his actions, and both parties agreed that a special verdict was open. A special verdict of not guilty of murder by reason of mental illness was therefore returned, and detention orders were made under s 39.
