Although the Crown proved beyond reasonable doubt the elements of murder in the absence of the defence, the psychiatric evidence established on the balance of probabilities that the accused was suffering from paranoid schizophrenia at the time of the killing and was thereby deprived of capacity to know that killing David Dodman was wrong; the proper verdict was therefore not guilty on the ground of mental illness.
