The Court was satisfied on the balance of probabilities that, when Mr Azbaa killed Anil Herat by inflicting multiple stab wounds, he was suffering from an acute exacerbation of chronic schizophrenia such that he did not know that it was wrong by acceptable community standards to act as he did. A special verdict of not guilty of murder by reason of mental illness was therefore returned under s 38 of the Mental Health (Forensic Provisions) Act 1990 (NSW).
