R v Michael KUTSCHERA [2008] NSWSC 1271
The offender deliberately manoeuvred the Nissan Patrol at and over the deceased's upper body while the deceased was prone and unable to defend himself, intending to kill him. Although the intention was formed impulsively and without premeditation, the deliberate use of the vehicle as a weapon, the deceased's vulnerability, and the offender's cold and calculated conduct afterward placed the murder within the mid range of objective seriousness. The offender's asserted mitigating factors did not justify departure from the 20-year standard non-parole period.
