R v DEBS [2012] NSWSC 119

The murder of Donna Hicks was a cold-blooded execution of a vulnerable woman with whom the offender had just had intercourse, committed without any normal or rational motive and as an exercise of power or for thrill or satisfaction. When combined with the similar killing of Kristy Harty, the circumstances demonstrated a complete lack of humanity, no remorse, likelihood of re-offending, no reasonable prospect of rehabilitation and continuing danger to the community. Although protection of the community could not justify a sentence beyond what was proportionate, the offence was in the worst case category and life imprisonment was the only appropriate sentence.
