The Court was satisfied beyond reasonable doubt that Brian Lee intentionally stabbed Klaus Petr and that, but for the mental illness defence, the Crown had proved murder. On the psychiatric evidence, the Court was satisfied on the balance of probabilities that the Accused had chronic schizophrenia, a mental illness, and that at the time of the killing his delusions and hallucinations meant he did not know that what he was doing was wrong according to the ordinary standards of reasonable people. A special verdict of not guilty of murder on the grounds of mental illness was therefore required.
