Although the evidence established beyond reasonable doubt that the accused intentionally killed the deceased, the psychiatric evidence and surrounding facts showed on the balance of probabilities that he was suffering from a psychotic illness causing delusional beliefs and disordered reasoning, so that he could not appreciate the moral wrongness of the killing according to the relevant legal test. The defence of mental illness was therefore made out.
