Although the murder was horrific, painful, callous and involved extreme gratuitous cruelty, torture-like conduct, use of a weapon and commission while the prisoner had escaped from custody, the Court was not satisfied beyond the requisite standard that it was premeditated. Absent premeditation and equivalent factors, the offence did not reach the level of culpability required by s61(1) for life imprisonment. A total sentence of 30 years with a non-parole period of 23 years was required to denounce the crime, punish the prisoner, deter, protect the community and allow for eventual supervised rehabilitation.
