Although the offence was extremely grave, involved a loaded firearm during an attempted armed robbery, caused the death of Ian Hagarty, and was committed by a prisoner with an appalling history of armed robberies, escapes and parole breaches, the court was not satisfied that the s.431B criteria requiring mandatory penal servitude for life were met. The community interests in retribution, punishment, community protection and deterrence could be met by a determinate sentence of great severity. Drug addiction and intoxication did not mitigate the objective seriousness of the offence in the circumstances.
