Preston v Nikolaidis [2023] NSWSC 316
The files sought by Mr Preston were goods within Limitation Act 1969, s 68; the Firm was in possession of them and claimed a lien for unpaid fees. Although the Firm's cause of action to recover the fees had been extinguished by Limitation Act 1969, ss 14 and 63, s 68 saved the Firm's debt or money claim from extinction so far as necessary to support and give effect to the possessory lien. Accordingly, the Firm's lien over the files had not been extinguished, and Mr Preston could not obtain delivery up of files subject to the lien without payment of the costs secured by the lien or payment into Court as a condition imposed by the Court.
