The plaintiffs' challenges to the validity of the Minister's reference to the Local Land Board are not made out. The Minister had statutory authority to refer any matter arising in connection with the road opening application to the Local Land Board under s260 of the Roads Act 1993, and such referral does not affect substantive rights so as to attract a requirement of procedural fairness at the stage of referral.
