SZISS v Minister for Immigration & Citizenship [2008] FCA 279
Although the applicants had an adequate explanation for their delay, none of the proposed appeal grounds had any realistic prospect of success. The refusal of an adjournment did not deny procedural fairness because the existing judicial review grounds were without substance and an adjournment would not have advanced the case. The proposed Tribunal grounds concerning hearing tapes, country information, the Document Examination Unit report, response time and s 424A(1)(b) did not disclose arguable jurisdictional error. Accordingly, there were no special reasons to extend time and the applications were dismissed.
