R v Phillips [2024] NSWDC 293

R v Phillips [2024] NSWDC 293

Having assessed the objective seriousness of the offences, the aggravating fact that all offences were committed while the offender was on parole, the further aggravation that the second offence occurred in the victim's home, the offender's deprived childhood, mental health and substance use disorders, youth, guarded rehabilitation prospects, early guilty pleas and the principle of totality, the Court concluded that only full-time imprisonment was appropriate and imposed an aggregate sentence with special circumstances allowing a longer parole period.
