Although the offence was serious, involved an apparent firearm and was committed while the offender was at conditional liberty, the weapon had to be treated as an imitation firearm and the offence was assessed towards the lower end of seriousness. The offender's extreme childhood deprivation, institutional sexual abuse, trauma, drug addiction and mental health conditions significantly reduced his culpability, made general deterrence inappropriate, and, together with new family support and time already spent in custody, justified adjourning sentence under s 11(1) and granting bail to test his prospects of rehabilitation.
